1870, c. 152 adds the following:

Powers of
register during
recess of or-
phans' court.
|
168. The register of wills of Worcester county, in
the recess of the orphans' court of said county, may
pass any account or claim against the estate of a
deceased person for any amount not exceeding one
hundred dollars, and on the return of any inventory
of the personal estate of a deceased person, may pass
an order for a public sale of the property contained
therein, in a case where, by law, said court could have
passed such order.

ens protected.

169. It shall not be lawful for any person to shoot
at, trap, catch, or in any manner take or kill any prai-
rie chicken in Worcester county within four years from
the date of the passage of this act.

Penalty for
killing.
|
170. If any person shall violate any of the provi-
sions of this act, he shall forfeit the gun or other in-
strument used in said taking or killing, and shall be
deemed guilty of a misdemeanor, and shall pay a fine
of not less than ten nor more than twenty dollars, to
be recovered by action of debt in the name of the
state, before a justice of the peace for Worcester county
aforesaid, or by indictment in the circuit court of said
county, said fine to be paid the one-half to the in-
former and the other half to the board of county school
commissioners for said county.
