ART. 21. ] WASHINGTON COUNTY.

court may direct another inquisition in the manner
hereinbefore prescribed, and every such inquisition
shall describe the property taken and the bounds of
the lands condemned, and the quantity or duration of
the interest in the same condemned for the corpora-

tion, and such valuation, when paid or tendered to the
owner of said property or his attorney, shall entitle
said corporation to the estate and property so valued
as fully as if the same had been conveyed by the owner
thereof.

344. The burgess and commissioners of said town
shall have power to regulate the rents or tolls of said
water, the net proceeds of which are pledged and ap-
propriated for the payment of the interest and the
re-imbursement of the principal of the debt that may
be contracted or incurred by the said town on account
of said water-works, and the said rent and toll shall

be maintained at such rates as the said burgess and
commissioners may fix until said debt is paid, and the
said burgess and commissioners may from time to time
levy upon the assessable property within the taxable
limits of said corporation any sum which may be neces-
sary to discharge the principal and interest of said

Proviso

345. If any person shall wilfully pollute said water
by throwing any dead animal or other impure sub-
stance into the same, or by swimming, bathing or
washing themselves, or by washing clothes or the skins
of dead animals, or any other impure things therein,
or by erecting any necessary or other nuisance so near
the said water as to pollute the same, he shall forfeit
to the said corporation a sum not exceeding twenty
dollars for each offence, to be recovered by summons
before any justice of the peace for Washington county,
to be issued against the person so offending, if a free
man, otherwise against the husband, father or master
of the person so offending, who shall be answerable
therefor, and the person so offending shall be obliged
to remove such nuisance, or pay the sum of ten dol-
