255. In case any person shall refuse or neglect to

be unable to collect the said tax by process of law as
hereinbefore provided for, it shall be the duty of said

aforesaid, the said constable shall be entitled to receive
out of said fund the sum of ten cents, and for failure
to execute the provisions of this law in any material

in which case one-half of said fine shall be to the use of
the informer, and the other half to the use of said fund.

266. The money arising from the levy aforesaid shall
constitute a fund in the hands of the county commission-
ers for the respective counties aforesaid, for remunerat-
ing the owners of sheep in said counties for damages
sustained by sheep being destroyed or injured by dogs.

How damages
appraised.

257. In case any sheep shall be injured or destroyed
by dogs, the owner thereof or his agent may apply
to the nearest justice of the peace, who shall appoint
three disinterested persons to view and ascertain the
damages by him sustained, and they or a majority of
them shall certify the same under their hands and seals
to the county commissioners of the county wherein the
said injury or killing took place, and the said county
commissioners shall provide for the payment of the
same, together with the costs attending the said ap-
praisement out of the fund aforesaid, if there be so
much, or as soon as there shall be sufficient in their
hands to enable them to do so.
