238. In all cases of action of trespass, quare clausam
fregit, or legal process of any kind hereafter to be sued
out or commenced, to recover damages for trespass upon
lands in said districts of said county by any kind or
description of live stock, the defendant or defendants
may plead the general issue and give the special mat-
ter in evidence under this act, and the plaintiff or

plaintiffs in each and every suit shall be non-suited
and mulcted in costs, whenever it shall be clearly
proven, by legal and competent testimony, that the
lands whereon the said trespass shall be alleged to
have been done or committed was not enclosed ac-
cording to the provisions of this act.

FUR.
1870, c. 167 entitled an act for the better protection of fur in Dorchester and
Wicomico counties, adds the following:

239. No person or persons shall trap, shoot or in
any manner catch, kill or wound any muskrats, otter
or mink in Dorchester and Wicomico counties between
the first day of April and the fifteenth of December in
each and every year.

240. Any person caught or seen violating the pre-
ceding section of this article, shall be guilty of a misde-
meanor, and on conviction thereof, in the circuit court
for said counties, shall be fined not less than twenty
dollars nor more than thirty dollars, or be imprisoned
in the county jail not exceeding six months or until

the payment of said fines and costs; one-half of said
fine to be paid to the county commissioners of said
county in which the misdemeanor may have been com-
mitted for the use of the public schools of said county,
and the other half to the informer.
