249. A majority of the commissioners shall consti-
tute a quorum to transact business, and a majority
shall always govern, and in case of a vacancy in the
board of commissioners during the year, the remain-

First election.

250. It shall be the duty of the chief judge of the
circuit court for Baltimore county to appoint in writ-
ing, under his hand and seal, three judges to hold the
first election, which shall be on the first Monday in
April next, as hereinbefore provided, who shall keep
the polls open from twelve o'clock M. to five o'clock
P. M.; the said chief judge of the said court shall
further designate the place where the polls shall be
opened, and order such notice of the said election as
he may think proper to be given through the public
newspapers, or by hand-bills, or both; the voting

shall be by ballot, and all persons residing within
the corporate limits and entitled to vote for delegates
to the general assembly of Maryland, shall be entitled
to vote for commissioners of the said town; the said

judges of election shall make returns of the said elec-
tion under their hands and seals, or the hands and seals
of a majority of them, or the hand and seal of any one
of them, to be appointed by themselves, to the clerk
of the circuit court for Baltimore county, in a similar
manner as now provided by law in general elections
throughout this state; and it shall be the duty of the
said clerk, as soon as may be after the said returns are
made, to inform the commissioners so elected, and ad-
minister to them separately the following oath or affir-

mation: " I, ————, make oath on the holy evangely
of Almighty God, or affirm, that I will faithfully and
without partiality discharge the duties of commissioner
of Towsontown, to the best of my ability, so help me
God, " which shall be written in the text book for other
officers in the custody of the said clerk, and signed by
the said commissioners, severally, which said oath and
signing shall be deemed the qualification of the said
