ART. 15. ] MONTGOMERY COUNTY.

fees as a justice of the peace is allowed for similar
cases, and an appeal from his judgment, where the
demand exceeds five dollars, may be taken to the cir-
cuit court for the county, which shall hear and deter-
mine the matter as upon appeals from a justice of the
peace.

41. All officers elected under this charter shall,
before they enter upon the duties of their office, take
an oath that they will diligently and faithfully, to
the best of their judgment, discharge the duties of
their office without favor partiality or prejudice, and
shall file the certificate of the officer before whom
the same was taken among the records of the cor-
poration.

continue to act until other officers have been elected
and qualified in their places.

43. All fines and forfeitures imposed under the
ordinances of this corporation, shall be recoverable
before the president or a justice of the peace, similar
to the mode of collecting small debts.

44. The commissioners shall not receive any pay
or compensation for their services as such; the presi-
dent shall have power, when acting in the capacity
of justice of the peace, to charge the same rates as
are allowed by law to the justice of the peace.

45. The commissioners shall appoint a bailiff, who
shall preserve the peace and good order of the town,
and enforce all ordinances and by-laws passed by
them, and for that purpose shall have all the powers
of a constable and receive such compensation as they
may determine just and right.

bond with approved security for the faithful dis-
charge of the duties imposed by said commissioners.
