ART. 7.] CARROLL COUNTY.

the clerks of the circuit courts for said counties
within ten days after the passage of this act and be-
tween the first of September, and the first of October
in every second year thereafter, a fair and complete

list of all the white male taxable inhabitants or resi-
dents of said county, whose names appear on the tax
books of said county, and who are not known to said
clerks to be under the age of twenty-five years nor
above the age of seventy years : and to which said
list, so to be made and filed, the said clerks respec-
tively shall append a certificate that the said list is
full and fairly made ; and for making such list, the
said clerks shall receive such compensation as the
county commissioners may deem right and proper,

and for failure to perform the duty hereby imposed
the said clerks to the said commissioners shall forfeit
and pay a fine to the state of not less than five hun-
dred dollars, nor more than one thousand dollars, in
the discretion of the court to be recovered by indict-
ment as for a misdemeanor and the party upon con-
viction, shall be committed to the county jail, there
to remain until said fine and all costs accrued, shall
be fully paid ; and he shall be thenceforth wholly
incapable of holding or exercising the duties of the
said office of clerk to the county commissioners.

18. It shall be the duty of the judges of the circuit
courts for each of the counties of Washington, Fred-
erick and Carroll, within twenty days of and not less
than five days before the commencement of the seve-
ral terms of the courts of said counties next succeed-
ing the passage of this act, in the year one thousand
eight hundred and sixty-seven, and within the period
of one month of, and not less than twenty days before
the commencement of each, and every term of said
courts thereafter, at which juries are required to
attend, in the presence of such of the practising
members of the bar of said courts as shall think
proper to attend, notice of the time and place hav-
ing been first given to said members of the bar,
through the criers of said courts, to proceed to
