shall avail for all purposes as if it were the return of
the sheriff of the city or county in which suit may
have been instituted ; nothing, however, in this sec-
tion is to be construed as ousting the criminal juris-
diction of the proper courts in the premises. '

Tobacco fund.

642. All money now in the hands of the treasurer,
heretofore received from any one acting as tobacco
inspector, and all received by him in pursuance of
this article, and all fines, penalties and forfeitures
under this article, not otherwise provided for, shall
constitute a fund to be called the tobacco fund.

Appropriation
of fines.

543. Where no other appropriation is made of any
fine, penalty or forfeiture, referred to in the last pre-
ceding section, one-half thereof shall go to the in-
former, and the other half to the tobacco fund ; and
the interest of the informer therein, shall not dis-
qualify him as a witness in any action, civil or
criminal.

nished inspec-
tor.

544. The comptroller shall furnish a bound copy
of this act to each inspector appointed in pursuance
thereof.

1867, c. 368 adds the following sections to 1864, c. 346 to come in after section 50 of

said act:

be published.

645. It shall be the duty of each inspector to pub-
lish once in two months, in some newspaper having
the largest circulation in the city of Baltimore an
accurate and detailed statement of the number of
hogsheads of tobacco he may have in his ware-
house, and stored out, if he have any, when in-
spected, and their average weight, he shall also
have hand bills posted in and about his warehouse
directing public attention to said statement:

646. It shall be the duty of each inspector to have
his warehouse thoroughly cleaned out at least four
times a year, and he shall certify to the comptroller
quarterly that he has complied with the provisions
of this section.
