404 CITY OF BALTIMORE. [ART. 4.

charge or perform the duty connected therewith, or
the fidelity of the said person in discharging or per-
forming the same, said oath duly subscribed shall be
recorded in the office of the clerk of the superior
court of the city of Baltimore, who shall be entitled
to the usual fees for recording the same, and whose
certificate thereof, tinder his seal, shall be due evi-
dence thereof at law and in equity.

This act further provides, that the General Assembly hereby reserves to itself the
right to repeal, alter, change or amend the same at its pleasure.

In force from March 21, 1667.

HORSES AND CARRIAGES AT LIVERY.

1865, c. 163 adds the following sections under the above sub-title:

1865, c 163, s. 1.
Lien of livery
stable keeper
for charges.

280. It shall be lawful for any livery stable keeper
to retain in his custody, any horse, mare or gelding,
placed under his care for livery, and also any vehicle
until all charges for so keeping shall have been paid
by the owner or owners thereof.

How sale may
be made.

281. It shall and may be lawful for such livery
stable keeper to sell any such horse, mare or gelding,
or vehicle, at public auction, in the city of Baltimore,
after giving at least twenty days' notice in two of the
daily newspapers published in the city of Baltimore,
of the time, place and manner of sale, and after de-
ducting the amount due for keeping, together with
all expenses of said sale, to return the surplus, if
any, to the owner of such horse, mare or gelding,
or vehicle.

282. Before proceeding as above, it shall be neces-
sary for such livery stable keeper to state an account
for the keeping of such horse, mare or gelding, or
vehicle, and prove the same before a justice of the
peace for the city of Baltimore, who upon being sat-
isfied by proof of demand and refusal or neglect to
pay on the part of the owner, shall thereupon issue
