1867, c. 390 further amends and re-enacts section 55 as follows, as amended by 1866,
c. 144, s. 1, which act repealed 1865, c. 87, s. 1:

Liquor not to
be sold, &c., to
minors, &c

55. It shall not be lawful for any person, whether
licensed to sell spirituous liquors or not, to sell,
dispose of, barter or give, directly or indirectly,
within the corporate limits of the city of Annapolis
or within five miles thereof, any spirituous or fer-
mented liquors or cordials of any kind, or in any
quantity whatever, to any youth or minor under
the age of twenty-one years without the written

order of the parent or guardian of such minor, nor
to any midshipman or student connected with or

attached to the Naval Academy at Annapolis or
under orders to join or leave the said academy,
nor to any seaman, ordinary seaman, landsman,
marine or boy, or any employee of the navy with-
out a written order from a commissioned officer of
the navy, not including hired laborers, nor to any

ing the provisions of this section shall be liable to
indictment in the circuit court for Anne Arundel
county, and upon conviction thereof shall be fined
a sum. not less than one hundred dollars, nor more
than five hundred dollars, and also be imprisoned in
the county jail for not. less than five days and con-
fined until the said fine and costs of prosecution shall
be paid ; but if any minor or person named in this
section shall wilfully misrepresent that he is of full
age, or that he is not prohibited by this section, and
shall obtain any spirituous liquor, and the person
selling the same shall be able to prove such mis-
representation, the said person selling to the said
minor or other person so falsely representing him-
self shall not suffer any penalty, but the person so
offending shall pay all the costs incurred in such
case.
