ance and repairs of said road ; the amount of said
compensation to be ascertained by the affidavit of
the said superintendent, made quarterly before any
justice of the peace for Allegany county, and to be
paid out of the tolls of the road. Joseph Dilly,

 

Richard Beall and William R. Getty, are hereby
constituted a board of commissioners, whose duty it
shall be to supervise generally the working of said
road by the said superintendent, direct when and
where repairs shall be made, examine and audit his
accounts quarterly, said commissioners to serve for
one year from the first day of May eighteen hundred
and sixty-seven ; and further, it shall be the duty of
the county commissioners, at their regular meeting
in April in each and every year, to appoint three
good and discreet persons to act as such commis-
sioners, to serve without compensation.

1862, c. 176 repeals sections 108 and 111 and substitutes the following:

108. The person so appointed shall, before enter-
ing upon the duties of his office, and annually there-
after, give bond to the state of Maryland, with such
security as shall be approved by the judge of the
circuit court for Allegany county, in the sum. of fif-
teen hundred dollars, with the following condition,
or to the following effect : now the condition of the
above obligation is such, that if the above bound
—— —— shall well and faithfully discharge the
duties of superintendent, and shall pay over, lay out
and expend all moneys which he may receive as the
superintendent of that part of the United States
road within the limits of this state, as directed by
law, then the above obligation to be void, otherwise
to be in full force and virtue in law.
