vided, he is in other respects entitled to vote, by
having the requisite qualifications, of age, citizen-
ship, and residence, and be not disqualified under
the third and fifth sections of the first article of the

Proviso.

constitution ; and if any officer of registration shall
refuse to register as a qualified voter, any person so
as aforesaid applying to be registered or if any judge
of election shall refuse to receive the vote of such
person when registered, he shall upon conviction
thereof, before any court having criminal jurisdic-
tion, forfeit and pay a fine of not less than one hun-
dred and not more than five hundred dollars for
each offence and be imprisoned until said fine and
the costs of prosecution be fully paid and satisfied,

and shall also be liable in an action for damages at
the suit of the party aggrieved.

Action.
|

33. All courts and state, county, township and
municipal officers of this state shall take notice of
the provisions of this act, without requiring it to
be specially pleaded, set up or relied OD, and shall
give the full effect and benefit thereof to any person
embraced within the general description of the first
section of this act, in the same manner and to the
same extent as if the name of such person had been
expressed, and set out specially in the said foregoing
section.

PAYMENT OF REGISTRATION OFFICERS.
1967, c. 44 enacts as follows :

34. The register of the city of Baltimore, and the
county commissioners of the several counties of this
state, shall cause to be levied upon and collected from
the assessable property of the said city and counties,
a sum or sums of money sufficient to pay said officer
of registration their per diem as allowed in the act of
eighteen hundred and sixty-five, chapter one hun-
dred and seventy-four, with such additional sums as
