iHUSBAND AND WIFE. [ART. 45.

Neglect or
refusal.

ors and physicians, or any of them, shall neglect
or refuse so to file said oath taken, subscribed and
attested as aforesaid with the said clerk on or before
said day, the office of the person so neglecting or
refusing shall be ipso facto vacant, and the same
shall be filled as provided for by section four of this
article and for the purpose of so filling any vacancy
or vacancies so caused, three members of the board
shall constitute a quorum, and if said vacancy or
vacancies shall not be so filled by the visitors by the
fifteenth day of May, eighteen hundred and sixty-
four, the governor shall fill the same.

15. The president, vice president, visitors and phy-
sicians who may be hereafter elected or appointed
shall take, subscribe and file said oath before they
proceed to exercise any of the functions of their office
or appointment ; and the clerk of the superior court
shall communicate to the governor the names of all
the officers of said hospital, who shall file said oath
and the date at which it was filed.
