fied to by a competent surveyor, and said certificates of con-
demnation and survey, shall be filed in the county clerk's office,
and be recorded by said clerk within sixty days from date of
condemnation, as evidence of title, unless the judgment of con-
demnation by the trustees, shall be reversed by the Circuit
Court, for the county.
4. The owner of land so condemned shall have the right of
appeal to the Circuit Court, at the first term thereof, after such
condemnation, and the judgment of said court shall be final.
5. The value of the land and the damages assessed, shall, upon
final ratification, and after the erection of a suitable school
house thereon, be paid by order of the board of school com-
missioners out of the school fund; provided such value and
damages shall not exceed thirty dollars, but all other costs
accruing from such condemnation shall be provided for by the
trustees.

Chapter 156 repeals Sections 166,175, 178,177, 178, and enacts as follows:
SEC. 1. The act of incorporation of the town of Salisbury, in
Somerset and "Worcester counties, is hereby revived and made
as effectual, to all intents and purposes, as if the said act of in- '
corporation had not expired.
