sale or mortgage of said real estate, or so much thereof as may be
necessary to pay and satisfy the said incumbrances and all costs and
expenses incident thereof, the said sale or mortgage to be made by a
trustee or trustees to be appointed by the said court. But no sale or
mortgage as aforesaid shall be valid unless the same shall have been
reported to and approved by the said court.
SEC. 2. And be it enacted, That the said court shall have power
from time to time to authorize its trustee or trustees to lease said real
estate or any part or parts thereof for such terms, at such rents and on
such conditions as to the said court may appear just and reasonable.
SEC. 3. And be it enacted, That the parties complainant to the
aforesaid proceeding, may at their election make the Mayor and City
Council of Baltimore party defendant thereto, and the said court shall,
in its discretion, have power to stay by injunction any proceedings on
the part of the Mayor and City Council of Baltimore, to enforce pay-
ment of the claims intended to be provided for by this act, which may
embarrass the execution of this act.
SEC. 4. And be it enacted, That any sale, mortgage or lease made
according to the provisions of this act, shall bind and conclude all
titles and interests which may be derived under the last will of the said
Solomon Betts, deceased.
SEC. 5. And be it enacted, That this act shall take effect from the
day of the passage thereof.
MARY ANNA BIGGS.
AN ACT to authorize and empower Mary Anna Biggs, a minor of the State of Dela-
ware to divide certain real estate and to convey by good and sufficient deed or
deeds, such part thereof as may be necessary to complete such division, and to
accept and hold her proportion thereof in severalty as though, she were of full
age.
WHEREAS, John Biggs late of the State of Delaware, died intestate on
the fifth day of January, eighteen hundred and sixty, leaving as his
heirs at law, Benjamin T. Biggs, Sewell C. Biggs, Jane E. Brisbane,
formerly Jane B. Biggs, now the wife of William H. Brisbane, Joseph
Biggs, William P. Biggs and Mary Anna Biggs, all of whom are
over twenty-one years of age, except Mary Anna Biggs, who is now
about eighteen years of age;
AND WHEREAS, the said John Biggs was seized at the time of his death
of valuable real estate, part of which lies in New Castle county in
the State of Delaware, and part in Cecil county in the State of Mary-
land; which said real estate taken together is capable of advantage-
ous division amongst the parties in interest, but neither the Delaware
nor the Maryland lands, separate and apart from the other, are
capable of such division, and consequently the laws of neither State
