RELIEF OF.
HENRY R, ATKINSON.
AN ACT to authorize the County Commissioners of Allegany county to levy one
hundred and forty-three dollars for Henry B. Atkinson, of Allegany county,
balance of jail fees, for commitments of one hundred and forty-three prisoners to
the jail of Allegany county, during his sheriffalty.
WHEREAS, The County Commissioners of Allegany county, in opposi-
tion to the practice prevailing for over thirty years past, refused to
levy for Henry R. Atkinson, late Sheriff of that county, the usual
commitment fee of two dollars and a half for each prisoner committed
to the jail" of said county, on process issued by the State of Maryland,
on the pretence that there was no express law of this State authoriz-
ing them to levy more than fifty cents for each commitment; and
whereas, the daily allowance of twenty-five cents for keeping each of
such prisoners, and the commitment fee of fifty cents for committing
each of same, are too small, as credibly represented, to cover the
actual expense of keeping and feeding the same; therefore,
SECTION 1. Be it enacted by the General Assembly of Maryland,
That the Commissioners of Allegany county, are hereby authorized to
levy for Henry R. Atkinson, late Sheriff of said county, one hundred
and forty-three dollars, for the balance of the usual commitment fees due
him, for committing one hundred and forty-three prisoners to the jail
of Allegany county, during his sheriffalty.
SEC. 2.. And be it enacted, That the Commissioners of Allegany
county are hereby authorized to levy for the use of Henry R. Atkinson,
late Sheriff of Allegany county, a sum sufficient, with what has been
paid, to make the sum of thirty-five cents per day, for board for all
prisoners in jail, and fed by said late Sheriff, during the term of his
sheriffalty.
SEC, 3. And be it enacted, That section one hundred and fifty-nine
of Article one of the Code of Public Local Laws, relating to Allegany
county, be and the same is hereby repealed and the following substituted
therefor;
159. He shall be entitled to thirty-five cents per day for each pri-
soner committed to the jail of said county; and for the following sums
for taking convicts to the Penitentiary, to wit: when a single convict
is taken, forty dollars; when two are taken together, thirty dollars
each; when more than two, twenty-five dollars each; to be levied as
other county charges are.
SEC. 4. And be it enacted, That this act shall take effect from the
day of its passage.
