justice of the peace of said county, be fined in a sum not less
than twenty nor more than fifty dollars; said fines to be applied
to the primary school fund of Frederick county.
12. In the event of the failure or refusal of any person so con-
victed to pay such fine, the justice of the peace imposing said
fine shall commit him to the jail of Frederick county for not less
than three nor more than six months.
FREDERICK.
The Act of 1862, ch. 55, repeals section 89, and substitutes the following:
13. John Sifford, James Whitehill, and George Metzgar, are
hereby appointed judges, to hold the election for mayor and al-
dermen, and William Bentz is hereby appointed judge for ward
number one; David Frazier, judge for ward number two; Zeph-
aniah Harrison, judge for ward number three; Lewis Medtart,
judge for ward number four; John O. Hardt, judge for ward
number five; David T. Bennet, judge for ward number six, and
Henry Houck, judge for ward number seven, in Frederick, to
hold the election for members of the common council for Fred-
erick city, at the election to be held on the fourth Monday of
February, eighteen hundred and sixty-two; and in the event of
the death or refusal of any one or more of said judges to serve
as such, the mayor of said city is hereby authorized to fill such
vacancy; and all elections shall hereafter be held by such judge
or judges, and in such manner as shall be directed from time to
time by ordinance of said corporation, not inconsistent with the
provisions of this charter; and should there be hereafter, at any
time, one or more vacancies in the office of, or a failure to ap-
point any of the judges of the election, for any officer to be
elected under this charter, the said mayor shall be and he is
hereby authorized and empowered, and required to fill such
vacancy, or to appoint said judges.
The Act of 1862, ch. 63, adds the following:
14. The mayor, aldermen, and common council of Frederick
are hereby authorized and empowered to hold elections for the
