of the Circuit Courts in the Counties shall apply to the
Clerks of the Courts in Baltimore City.
40.
The qualified voters of the City of Baltimore, and
of the several Counties, except Montgomery Ccunty and
Harford County, shall [on Tuesday next after the first
Monday in November, nineteen hundred and seventy—four,
and on the same day in every fourth year thereafter,]
elect three [men to be] Judges of the Orphans' Courts of
[said] City and Counties, respectively, who shall be
citizens of the State£,] and residents, for the twelve
months preceding, in the City[,] or County[,] for which
they may be elected. They shall have all the powers now
vested in the Orphans' Courts of the State, subject to
such changes as the Legislature may prescribe. Each of
[said] THE Judges shall te paid such compensation as may
be regulated by Law, [and] to be paid by the [said]
City[, ] or Counties, respectively. In case of a vacancy
in the office of Judge of the Orphans' Court, the
Governor shall appoint, subject to confirmation[,] or
rejection by the Senate, some suitable person to fill the
[same] VACANCY for the residue of the term.
41-1.
For the purpose of implementing the amendments to
Articles IV, XV and XVII of this Constitution,
establishing the District Court, the following provisions
shall govern.
(a) [If for any reason these amendments are not
submitted for adoption or rejection by the legal and
qualified voters of the State in November, 1969, but are
submitted to such voters in 1970, then whenever a day of
a month in the year 1970 is used in these amendments it
shall mean the same day and month in the year 1971.]
[(b) Unless specifically otherwise provided, each
of said amendments shall take effect on the first Monday
in July, 1970, except those pertaining to the offices of
chief judge and chief clerk of the District Court, which
said offices shall be created and which said provisions
shall take effect on May 1, 1970. On or within ten days
after that date, the Governor shall appoint some person
qualified under Section 2 of this Article as the first
Chief Judge of the District Court, but all subsequent
Chief Judges shall be designated as provided in Section
41D of this Article IV.]
[ (c) The General Assembly by law may postpone the
effective date of these amendments in any District or
Districts which include a county not having a full time
People's Court, but only if the County Commissioners or
Council of any such County comprising a District, or part
thereof, by resolution adopted by then and concurred in
by the County Executive, if any, and addressed to the
