the passage of such budget bill shall operate as an amendment to such Act
to the extent of such increase or decrease, within the limits permitted by the
Constitution of Maryland.

1939, ch. 64, sec. 12.

12. No department, board, commission, officer or institution of the
State shall at any time spend in excess of the total amount of its ap-
propriation, and no department, board, commission, officer or institution
shall spend in excess of the amount of any item in its appropriation except
upon compliance with the provisions of Section 8 hereof. If any such
department, board, commission, officer or institution shall violate the
provisions of this section, there shall be no reimbursement of such excess
nor shall there be any liability or obligation upon the State to make any
appropriation thereafter to meet such deficit. Any officer or employee of
the State, or the members of any department, board, commission, institu-
tion or agency, who shall have made any such excessive expenditure, shall
be deemed guilty of neglect of official duty, and shall be subject to removal
therefor.

Department of Budget and Procurement.

1939, ch. 64, sec. 13.

13. The Department of Budget and Procurement is hereby created
under the direction, supervision and control of a Director of Budget and
Procurement, who shall be appointed by the Governor and hold office as
long as he performs his duties in a competent manner. He shall be re-
movable by the Governor only in the manner by which civil officers may
be removed by the Governor under the provisions of Section 15, Article 2
of the Constitution, and shall receive such salary as is fixed in the Budget.
The Director shall appoint a Chief of the Budget Bureau, a Chief of the
Purchasing Bureau and such other employees and assistants as he may
deem necessary, who shall receive such compensation as may be provided
in the Budget; but the Chiefs of said Bureaus and all other employees
and assistants shall be appointed in accordance with the provisions of
Article 64A of the Annotated Code of Maryland.

1939, ch. 64, sec. 14.

14. It shall be the duty of the Director of Budget and Procurement,
hereinafter referred to as the Director, to continuously study and analyze
the needs of the several departments, boards, commissions, bureaus, divi-
sions, instititions and agencies of the State, and of all private associations,
corporations or institutions which receive any funds appropriated by the
State for any purpose whatsoever; and to continuously study and analyze
the current progress of revenue receipts in relation to such needs.

15. The Director shall have the power to examine any officer or em-
ployee of the above mentioned departments, boards, commissions, bureaus,
divisions, institutions or agencies of the State, or of any private association,
corporation or institution receiving any funds appropriated by the State
as to any and all information which may be desired, and to examine the
