ciations of Morgan College shall be recognized by the State institution.
The rank and status of each student of Morgan College, as certified by the
dean and approved by the president thereof, shall be accepted by the State
College as the basis for the organization of the students.

10. The Attorney-General of the State shall be the legal adviser of
the Board of Trustees, and shall institute, prosecute and defend all suits
of 1 their behalf.

11. If the transfer contemplated in the foregoing sections of this
Article takes place, all monies appropriated by the General Assembly of
Marylander the current expenses of Morgan College for the fiscal years
1939, 1940 and 1941, and not paid over to Morgan College prior to the
transfer of the property to Morgan State College, are hereby transferred
and credited to the use of Morgan State College and shall be disbursed ac-
cording to the Budget Law.

12. If the transfer contemplated in the foregoing sections of this
Article takes place, all monies appropriated by the General Assembly of
Maryland for scholarships and partial scholarships for Negroes, to be
awarded by the Commission on Scholarships for Negroes under Chapter
506 of the Acts of 1939, shall be credited to the Board of Trustees of
Morgan State College and shall be used by said Board, in its discretion,
either for the current expenses of the college, or for the award of scholar-
ships in conformity with the conditions laid down in said Act, or for both,
and shall be disbursed according to the Budget Law.

13. The Commission on a State College for Negroes, herein created
and established, is hereby authorized and directed to consider to what ex-
tent the proceeds of any State loan that may be authorized by the General
Assembly of Maryland of 1939 for the benefit of Morgan State College,
contingent upon its acquisition of the property of Morgan College, shall
be expended by the Board of Public Works in conformity with the purposes
of this Article to comply with the terms of the agreement of transfer, or
in the purchase of additional land or equipment or the erection of additional
buildings, or the improvement of the buildings and grounds of Morgan
State College, either with or without the aid of such additional funds
as may be received from the United States; provided, that the determina-
tion of said Commission in these respects shall not be effective until ap-
proved by the Board of Public Works. The Commission shall notify the
Board of Public Works of its determination, and shall file a copy thereof
in the office of the Secretary of State, and if the same shall be approved
by the Board of Public Works, the said Board shall expend the proceeds
of said State loan in accordance therewith, or as otherwise provided in the
Act providing for said State loan.
