tions nor make determinations pursuant to such petitions in accordance
with the provisions of this sub-title, more often than one in five ( 5) years

59. If any provision of this sub-title, or the application of any pro-
vision to any person or circumstance, is held invalid, the remainder of the
sub-title, and the application of such provision to other persons or circum-
stances, shall not be affected thereby.

Insofar as any of the provisions of this sub-title are inconsistent with
the provisions of any other law, the provisions of this sub-title shall be
controlling.

Trade Marks for Farm Products.

60 For the purposes of this sub-title, unless otherwise required by the
context:

(a) The term "Board" means the Maryland State Board of Agriculture

(b) The term "Department" means the Maryland State Department of
Markets of the Extension Service of the University of Maryland

(c) The term "person" means any individual, firm, corporation or
association.

(d) The term "farm product" means any agricultural, horticultural,
vegetable or fruit product of the soil, whether raw, canned, frozen, dried,
pickled, or otherwise processed, live stock, meats, marine food products,
poultry, eggs, dairy products, wool, hides, feathers, nuts, honey and every
product of farm, forest, orchard, garden or water

61 The State Board of Agriculture may:

(1) devise and establish official trade marks or other insignia for farm
products of this State and may secure copyrights therefor under the law
of the United States or of this State,

(2) permit the use of such official trade marks or other insignia upon
farm products of this State or upon the containers thereof and charge
reasonable and necessary fees for such use;

(3) prevent the unauthorized or improper use of such official trade
marks or other insignia and protect the same from infringements; and

(4) promulgate from time to time rules and regulations and do anything
necessary to effectuate the purposes of this sub-title.

62 Any person whose power or duty it is to enforce the provisions
of this sub-title may enter any building, vehicle or other enclosure or con-
veyance within this State, where any farm product is produced, stored,
sold, offered or exposed for sale, packed for sale, is being transported for
sale, shipped, or presented for intrastate or interstate shipment, and may
examine any farm product found in any such place, and may take for
further examination such samples of the farm products and containers
thereof as may be necessary to determine whether or not this sub-title has
been violated.
