Certificates of inspection issued by all such inspectors shall be accepted
as prima facie evidence in any Court of the facts contained therein.

1939, ch. 575, sec. 38.

38. Any person who sells any fruit or vegetable in a container which
is not properly marked shall not be prosecuted therefor when he can
establish by satisfactory evidence that he was not a party to the grading
or packing of the fruit or vegetable in question, and had no knowledge
that the same was mismarked or illegally packed.

1939, ch 575, sec. 39.

39. This sub-title shall not be construed as repealing any existing law,
but shall be in addition thereto, and the powers and duties herein vested
in the State Board of Agriculture and the Maryland State Department of
Markets shall be in addition to, and not in limitation of, any powers or
duties which now are, or hereafter may be conferred upon the State Board
of Agriculture or the Maryland State Department of Markets.

40. If any of the provisions of this sub-title or the application thereof
to any person or circumstance is held invalid, or is in conflict with any
Federal law, the validity of the remainder of the sub-title and the applica-
tion thereof to other persons or circumstances shall not be affected thereby.

Soil Conservation.

1937, ch. 220, sec. 15.

41. The State of Maryland hereby adopts the policy of cooperating
with the governments and agencies of other states and of the United
States in carrying out the policy and purposes specified in Section 7 (a)
of the Act of Congress known as "Soil Conservation and Domestic Allot-
ment Act" (Public No. 46, 74th Congress, approved by the President of
the United States April 27, 1935, as amended by Public 'No. 461, 74th
Congress, approved February 29, 1936).

42. The University of Maryland is hereby designated and authorized
as the State agency of this State to formulate, submit to the Secretary of
Agriculture of the United States and carry out State agricultural plans
pursuant to the provisions of Section 7 of said Soil Conservation and
Domestic Allotment Act.

1937, ch. 220, sec 17.

43. The University of Maryland is hereby authorized and empowered:

(1) To formulate, pursuant to the standards therefor set forth in Sec-
tion 7 (a) of said Act of Congress, agricultural plans for this State for
each calendar year, commencing with the year 1938, and from time to
time to make such revisions in such State agricultural plans as may be
necessary to conform to such standards;

(2) To utilize, in formulating and revising such State agricultural
plans, the assistance of the Agricultural Extension Service and the Agri-
cultural Experiment Station;
