FISH AND FISHERIES 1659

1929, ch. 471, sec. 40.

46. (Wicomico County.) It shall be unlawful for any person to catch
fish with any net within 500 yards on the lower side and 100 yards on
the upper side of the mouth of Quantico Creek, Ruvastico Creek or Bar-
ren Creek.

47. (Worcester County.) (a) It shall be unlawful for any person to
fish with stationary nets in that part of the waters of Sinepuxent
Bay north of South Point, Isle of Wight Bay, Assawoman Bay and St.
Martin's River, which is located equally at all points on either side of a
line drawn through the center of each of said waters, from the northern
to the southern extremity thereof, and extending in width at all points of
said line one-third part of the distance which separates the opposite shores
of the waters aforesaid at said points.

(b) It shall be unlawful for any person to haul or fish with any haul
or set seine, Or to leave or to permit to remain setting, any set seine in
any parts of the waters of Sinepuxent Bay and its tributaries north of
South Point, during the interval from the hours of 6 o'clock, P. M., Satur-
day of each week until the hour of 6 o'clock, A. M., of the following
Monday.

(c) No person other than an actual bona fide resident of Worcester
County, or unless he shall be a taxpayer upon property standing in his own
name in the said county, to the assessed valuation of $1,000.00 or more, or
unless he shall first take out a license as hereinafter provided, shall haul for
or catch fish with any seine, or set net of any description, in the waters of
Sinepuxent Bay or its tributaries within said county; and no person shall
fish in the waters of Sinepuxent Bay or its tributaries within the limits
of Worcester County with any seine or net of any description containing
meshes less than one and one-half inches square, except only during the
months of July, August, September and October, when this section shall
not apply to fishing for fat backs and crocus.

(d) The Clerk of the Court is authorized upon the payment to him of
the fee of $100.00, and upon application by a non-resident of the county
not being a taxpayer, as provided for above, to issue a license to such ap-
plicant authorizing him to fish for one year with seines and nets in the
waters of Sinepuxent Bay and its tributaries within said county as a
resident of the county is permitted to do.

(e) It shall be unlawful for any person to fish afr any time except by
rod, hook and line in that part of the waters of Hering Creek which lie
south of the dam, now partially constructed and intended to be completed,
and which dam is contiguous to and south of the state road bridge crossing
Hering Creek.

Nets and Seines.

1929, ch. 471, sec. 42.

48. ( Sizes of Mesh.) Unless otherwise provided in this Article, it shall
be unlawful after December 31st, 1931, to fish with any nets mentioned
in any section of this Article whose size of mesh is less than herein pro-
vided: Purse or Buck Nets, 3 inches; Pound Nets, 2 1/4 inches; Haul
Seines, 2 1/2 inches; Gill Nets, 2 1/2 inches; Fyke and Hoop Nets, 2 1/4
inches; provided, it shall be lawful to continue the use of such nets, now
