105. It shall be unlawful for any person to take or catch any terrapin
mentioned in this sub-title from the waters of any county other than that of
which is a resident.

This section referred to in discussing meaning of term "citizen"—see notes to
art. 25. sec. 143. Fitzwater v. Hydro-Elec. Corp., 149 Md. 466.

1929. ch. 266, sec. 5.

106. Any terrapin mentioned in this sub-title found in possession of
any person or any trap, snare, net or devices of any description, which are
being used for entrapping, except as herein provided, between the first day
of April and the thirty-first day of October, both dates inclusive, shall be

conclusive evidence of a violation of this sub-title, and shall be confiscated
by the State Game Warden, any Deputy Game Warden, Constable or Po-
lice Officer or any employee receiving compensation from the Conserva-
tion Department of Maryland, and disposed of by the State Game Warden
as he may deem advisable for the best interest of the State.

107. Any person violating any of the provisions of this sub-title shall
be deemed guilty of a misdemeanor and upon conviction before any Justice
of the Peace of this State, shall be fined not less than Fifty ($50) Dollars
nor more than One Hundred ($100) Dollars for each and every offense,
and in addition to said fine, shall be fined Five ($5) Dollars for each and
every terrapin found in possession in violation of this sub-title. Any per-
son who shall fail to pay the fine so imposed, shall stand committed to jail
until the fine and costs shall have been paid; however, said sentence shall
not exceed one day for each dollar so imposed.

Any person other than the State Game Warden, Deputy Game Warden
or employees receiving compensation from the Conservation Department
of Maryland, who shall procure the conviction of any person violating any
provision or provisions of this sub-title, shall receive one-half of the fine
recovered, the remaining one-half shall be paid to the State Game Warden

or State Comptroller, to be placed to the credit of the Conservation Fund
to be used as provided by law.

1929, ch. 266, sec 7.

108. If any clause, sentence, paragraph or section of this sub-title
shall, for any reason, be adjudged by any Court of competent jurisdiction
to be unconstitutional or invalid, said judgment shall not affect or impair
or invalidate the remainder thereof, but shall be confined in its operation
to the clause, sentence, paragraph or section thereof, so found unconstitu-
tional and invalid. 1
