It shall be unlawful to hunt wild waterfowl at any time or in any
manner on either the land or the waters within the boundary lines of the
Blackwater Migratory Bird Refuge located in Dorchester County, or to
hunt wild waterfowl on either land or water from a blind, or otherwise,
within 100 yards of the boundary lines of said refuge.
(b) The migratory game birds specified in this section may be taken
during the open season with a gun only, not carrying more than three
loads at any one time, loaded with shot only not larger than number ten
gauge, fired from the shoulder, from the land and water, with the aid of a
dog or dogs, and the use of decoys; provided, however, it shall be unlawful
to use more than twenty-five live decoys on any one property at any one
time. No water fowl, except crippled birds not otherwise retrievable,
shall be shot while resting on water or land, provided, however, it shall be
unlawful to use any airplane, sink box or sink boat, sneak boat, floating-
device, or any floating device towed by a power boat or a sail boat for the
purpose of hunting wild water fowl, therefrom; provided, it shall be law-
ful to use sink box, sink boat, sneak boat or bushwhack rig on the Susque-
hanna Flats. And it shall be lawful to use sneak boat or bushwhack rig-
on the waters of the Elk and Sassafras Rivers in Cecil County; provided
however, it shall be unlawful for more than four persons to hunt wild water
fowl from any blind located on land, or from any sink box or sneak boat or
bushwhack rig in any one day. Any gun which cannot be habitually-
raised and fired from the shoulder and any gun larger than number ten
gauge found in the vicinity of the resting and feeding areas of wild
water fowl may be confiscated by any officer of this State and delivered to
the Game Warden.
Provided, however, it shall be lawful to hunt wild water fowl on the
waters of the Potomac River in Frederick County and Montgomery County
from a skiff or row boat propelled by oar or oars only. The clerk of the
Circuit Court of Frederick County and Montgomery County upon, the
application of any resident of Frederick County or Montgomery County
respectively, being the owner of any skiff or row boat as herein allowed
to be used in hunting of water fowl on the waters of the Potomac River
in Frederick and Montgomery Counties shall issue to said applicant a
license under the seal of his court to gun for and shoot at water fowl from
such boat, the cost of which shall be Five ($5. 00) Dollars for each and
every boat and in addition to the moneys received from licenses, aforesaid,
the Clerk of the Court shall collect and retain in lieu of all compensation,
the sum of fifty (50c) cents for issuing said license. Every licensee shall
be required to paint his name and license number on some prominent part
of said skiff or row boat in large, legible letters and numbers, to correspond
with said name and number of license issued to him. Said license shall
only be valid during the open season provided by law for the hunting of
water fowl in this State.
The Clerk of the Circuit Court of Frederick County and Montgomery
County shall, on the first day of June, 1931, and on the first day of each
