92 ARTICLE 1.

by the said mayor and councilmen of Frostburg on the first Monday in
May of each and every year, and the other two to be elected by the people
at the regular election for mayor and councilmen on the first Monday in
April next succeeding the passage of this Act, and annually thereafter;
and the said mayor and councilmen may allow to the members of the
said water board such compensation for their services as the said mayor
and councilmen may deem just and reasonable not exceeding one hundred
dollars each per annum.

254. Before entering upon their duties under this Act, the members of
the said water board shall make oath before the mayor or some justice
of the peace that they will diligently and faithfully perform the duties

of their office to the best of their judgment, they shall then, on the first
Tuesday after the first Monday in May, meet and arrange and choose from
among their number a president and a secretary, and each member of the
said water board shall give bond to the said mayor and councilmen of
Frostburg in the penal sum of one thousand dollars conditioned upon the
faithful performance of his duties as a member of the said water board,

and it shall be the duty of the said water board to make a full financial
report to the mayor and councilmen of Frostburg at their regular meet-
ings on the second Wednesday in July, October, January and April of
each year.

255. No moneys shall be paid from the town treasury for any of the
purposes of this Act, except upon the warrant of the said Water Board

duly signed by the president and the secretary thereof.

1890, ch. 130, sec. 7.

256. The said Water Board are hereby authorized and empowered to
build and erect water works for the said town and to contract for, pur-
chase in fee-simple or lease for a term of years any land, real estate,
spring, brook, water-works, water and water-course, and to use and occupy
forever, or for a term of years, any land, real estate, sprrig, brook, water-
works, water or water-course which they may deem expedient and neces-
sary for the purpose of furnishing said town with water, and also the
right to enter and pass through from time to time as occasion may require,
and to use and occupy the said lands through which they may deem it
necessary to convey said water, and they are hereby vested with all the
right and powers necessary for the introduction of water into the said
town.

257. The said Water Board are hereby authorized and empowered to
agree with the owner or owners thereof for the purchase of any land, real
or leasehold estate, spring, brook, water-works, water or water-course,
