poses, which in their judgment they may deem advisable in the interest
of the City of Frostburg and for the pleasure, use. and enjoyment of the
citizens of Frostburg; said Mayor and Councilmen of Frostburg are also
empowered to maintain, control, and regulate any such parks and play-
grounds which they may establish, and for the purpose of carrying out
such regulations shall have power by ordinance to promulgate the same
and impose fines and penalties for violations thereof.

251. The Mayor and Councilmen of Frostburg are likewise authorized
and empowered to appoint a Board of Park and Playground Commis-
sioners consisting of not less than three nor more than five members, all
of whom shall be citizens of Frostburg, to serve without pay for a period
of two years from the date of their appointment. The Board created
shall have the charge, management, and control of any park or play-
ground established by the Mayor and Councilmen of Frostburg under the
provisions of this Act.

252. If the Mayor and Councilmen can not agree with any owner of
land in fee simple or leasehold estate, through which they find it neces-
sary to pass for sewerage, drainage or for any other necessary purpose,
inside or outside of the Corporate limits of the said Town of Frostburg,
may condemn the same, or if the owner is under any disability, incapac-
ity to contract, or absent from the county, or unknown, it shall be lawful
for said Mayor and Councilmen, through their attorney, to apply to any
Justice of the Peace of Allegany County, who shall issue his warrant to
the Sheriff of said County, requiring him to summons a jury of twenty
inhabitants of said County, not interested in the property to be valued, to
meet on or near the land on a day named in said summons, not less than
fifteen nor more than thirty days after the issuing of the same, for the
purpose of condemning such property and if either party is dissatisfied
with the inquisition rendered by the jury they may within ten days there-
after take the matter before the Circuit Court for Allegany County in the
same manner as other condemnation proceedings are taken before said
Court.

253. The Frostburg Water Board shall consist of three members to be
annually chosen as follows, namely: one from among their own number
