86 ARTICLE 1.

1900, ch. 639, sec. 3.

235. It shall 'be the duty of the Mayor and Councilmen to furnish
the collector with books for keeping his accounts in, shall furnish him
with a list of all taxes, water rents and assessments which books he shall
return to the Mayor and Councilmen when he shall have completed the
duties of his office and when he shall have paid over to the Treasurer of
the said Town all money that was his duty to collect, then the said Mayor
and Councilmen shall return to him his bond. In case of default of any
tax collector suit may be brought against his bondsmen within five years
from the expiration of his term of office.

236. If the tax collector shall neglect to report as required by the
aforegoing section he may be called before the Mayor and Councilmen and
by them fined the sum of ten dollars, which fine may be deducted from
his salary or collected as other fines are.

237. Before the tax collector shall enter upon his duties he shall take
and subscribe to the following oath, before the Mayor, I————having
been elected tax collector by the Mayor and Councilmen of the town of
Frostburg, in the presence of Almighty God, do solemnly, promise and
declare that I will faithfully perform the duty of tax collector and will
collect all taxes, water rents and assessments according to law without
fear, favor, or partiality.

238. In any and all cases where any street, lane or alley, or any part
thereof, in the town of Frostburg, has been graded, paved or curbed or re-
graded, repaved or recurbed under any ordinance, whether defective or not,
which provided for assessing the whole or any portion of the cost of such
improvement upon the property binding on such street, lane or alley, or
part thereof, and upon the property line, track or franchise right of any
street car company located and having its tracks upon said street, lane or
alley, so improved, and such assessments, or any part thereof, remain un-
paid, it shall be lawful for the Mayor and Councilmen of the town of Frost-
burg to provide by ordinance for the appointment of commissioners, to
assess the value of such improvements and for the levy and collection, in
such manner as they may deem proper, of a tax upon all the property bind-
ing on any street, lane or alley, or part thereof and upon the property line,
track or franchise right of any street car company located and having its
tracks upon said street, lane or alley, or part thereof, which may have been
so improved, to the extent that such property shall have been specially
benefited by such improvement; provided, that no property upon which the
assessment originally made for its share of the cost of such improvement
shall have been paid, shall be again assessed, and that reasonable notice
and an opportunity to be heard shall be given to all persons interested be-
