5260 ARTICLE 24.

sale of intoxicating drinks and any and all other unlawful and criminal
acts and conduct whatsoever within the corporate limits of said town.
Upon the application of any policeman for a warrant of arrest, and upon
the information, on oath, of such officer or any other person who appears
before him any Justice of the Peace having jurisdiction and authorized to
issue such a warrant or writ shall issue the same directly to said police-
man, commanding him to make the arrest of the person or persons named
in the information, and said officer shall execute and return said warrant
or writ and any writ or warrant directed to the chief of police of Poco-
moke City may be served by any policeman or night watchman of said
town and when so served shall have the same force and effect and be enti-
tled to and receive the same credence as if returned by the said chief of
police. The fines imposed in any case, on trial and conviction of a de-
fendant for any offense committed within the limits of said town, whether
under the general law of the State or under the local law or ordinances
of the town wherein the original warrant or writ for arrest was directed
to any policeman of said town, shall be paid over by the Justice of the

Peace before whom said case was tried to the town clerk, less any part
thereof appropriated by law to an informer; said fines to be a part of the
revenue of the town. If any crime or offense against the laws shall be
committed in the presence of any policeman he shall arrest the offender
without warrant and, if between sunset on one day and sunrise on the
next day, or at any time on Sunday or a legal holiday, any policeman has
occasion to arrest any person or persons for any offense committed in said
town, whether the offense was committed in the presence of the officer or
otherwise, and the said policeman, believes that under the circumstances
he ought to make the arrest without delay, said officer may make the arrest
without a warrant and may place the prisoner in the lockup until the
following morning until such hour as a warrant can be obtained. And
the said chief of police and the other policemen shall perform such other
duties as may be imposed upon him, or them, by the charter or ordinances
of the town or as may be assigned to them by the Mayor and Council.
They shall pay over all fines coming into their hands to the town clerk
monthly and the amount thereof shall be entered upon the minutes. Each
policeman before entering upon the discharge of his duties shall take the
oath required by Article 1, Section 6, of the Constitution of the State of
Maryland. If any vacancies shall occur in the offices of the town clerk,
town treasurer, superintendent of water works, attorney, policeman, night
watchman or any other appointed officer, the Mayor, by and with the
advice and approval of the Council, shall appoint a successor to serve out
the unexpired term for which the original appointment was made.
