Circuit Court for Wicomico County, who shall record said returns and
preserve said ballots for at least two months; the Clerk shall issue cer-
tificates of election to the persons appearing by said return to have re-
ceived the largest number of votes; said certificates shall be recorded in
the proceedings of said Council. Should the Mayor wilfully fail to per-
form any of his duties under this section he shall be deemed guilty of a
misdemeanor, and on conviction be fined not less than twenty-five dollars
and coats, and be committed to the County jail until paid, or both, at the
discretion of the Court. All the judges of election under this Act, whether
appointed by the Mayor or otherwise, are hereby declared subject to the
provisions and penalties of this section. All offenses hereunder to be
prosecuted under indictment in the Circuit Court for Wicomico County,
the fines to be paid to the City Treasurer for use of the streets of said City.

264. In case the Mayor shall fail, neglect or refuse to give notice of any
election to be held under this Act, as hereinbefore provided, any five quali-
fied voters of the city of Salisbury may give such notice in such manner as
they deem best, and any election held under such notice shall be as legal
and binding as if held under the notice of said Mayor, and shall be held
in and returned in the same manner as if held under notice of the Mayor,
and the judges thereof shall proceed in the same manner as if appointed
by the Mayor, and shall be liable to the same penalties as judges acting at
an election held under the authority of said Mayor.

265. If any of the judges at such an election shall wilfully make a
false return in same, he or they shall be deemed guilty of a felony, and
on conviction shall be sentenced to the penitentiary for not less than one
or more than ten years.

266. (a) It shall foe the duty of the Mayor and Council of Salisbury
to provide for each City and Primary Election a suitable place or places
for voting in each precinct, suitable ballot boxes and ballots in the form
and arranged as provided in Section 63 of Article 33, of the Annotated
Code of Maryland (1924 Ed.), except that such ballots shall contain the
name of every candidate whose nomination has been certified to and filed
according to the provisions of this Act.
(b) No person shall be a candidate for any public office in the govern-
ment of the City of Salisbury unless such person shall be nominated either
by a primary election held as hereinafter provided or by petition in con-
formity with the requirements herein.
(c) A candidate for a public office in the government of the City of
Salisbury shall be deemed to have been nominated by petition when he,
or someone in his behalf, shall file, at least ten days prior to the time for
holding the election at which he desires to be voted on, with the Clerk of
Salisbury a certificate signed by at least two hundred qualified voters con-
