or indirectly in any contract or contracts relating to any road, bridge or
drain.

1912, ch. 331, sec. 118.

239. The County Road Engineer may contract with and appoint by
and with the consent of the County Commissioners, Road Supervisors for
any road or roads in Wicomico county, who shall be under the control and
direction of the Road Engineer, and on failure to comply with their con-
tract or contracts, or failure to perform their duties may be suspended or
removed at any time by the County Road Engineer for good and sufficient
reasons and the vacancy supplied in the manner above prescribed.

240. It shall be the duty of the County Commissioners aforesaid
whenever the office of the County Road Engineer shall become vacant by
death, resignation or removal from office, to appoint, within sixty days
from the date of such vacancy, some person in the same manner and with
the same qualifications as hereinbefore prescribed to fill said office of
County Road Engineer for the residue of the period of two years for
which the person dying or resigning, or so removed from office, was
appointed.

241. All expenditures incurred under the provisions of the preceding
sections shall be paid out of the road fund of twenty cents on the one
hundred dollars of the assessable basis of Wicomico county, unless other-
wise ordered by the County Commissioners. And all other money ex-
pended beyond the amount of said road fund shall be included in the
report of the County Road Engineer as well as money expended from the
road fund.

242. Any person appointed under the provisions of this act, whose
duty it shall be to keep accounts or make reports and shall fail to do so,
or who shall wilfully make false reports to accounts shall be guilty of a
misdemeanor, and on indictment and conviction in the Circuit Court for
Wicomico County shall be subject to a fine in the discretion of the Court
not exceeding five hundred dollars, and in default of payment of fine and
costs shall be confined in the county jail of Wicomico county until fine
and costs are paid. And such criminal prosecution shall not preclude
the County Commissioners from recovery by suit for neglect of duty or
fraud, or by suit on his or their bond.

243. Whenever any person or persons shall desire to improve any
public road or any portion of any public road in said county to any extent
beyond that contemplated by the County Road Engineer, he or they may
make application to the County Commissioners by petition, setting forth
