5052 ARTICLE 23.

of his skill and judgment, perform the duties of Commissioner of said
town without favor, partiality or prejudice; and a certificate of such quali-
fication shall be made by the justice of the peace, and shall be filed and
recorded among the records of proceedings of said Commissioners.

184. At the first meeting they shall appoint one of their number as
president, who shall preside at the meetings of the board when pres-
ent, give direction to the bailiff by advice of the Commissioners, and
a majority of the Commissioners constitute a quorum to transact business,
and may, in absence of the president, select a president pro tem.

185. The said Commissioners shall appoint a clerk, who may be one of
their number, and to prescribe his duties and salary. The clerk shall keep
a book or record of the proceedings and ordinances of said Commissioners,
which shall be open for inspection of any person interested.

186. The said Commissioners shall elect one of their number treasurer
of the corporation, who shall keep an account of their receipts and dis-
bursements of the funds of the corporation, and shall render annually a
succinct and detailed statement thereof, which shall be posted in some
public place in said town, but before the said treasurer acts as such he
shall give bond for such amount as the Commissioners shall prescribe for
the faithful performance of his duties as treasurer.

187. The said Commissioners shall appoint a bailiff of said town (who
may be allowed to hold office of collector of taxes) and to prescribe his
duties; and the bailiff shall enforce the town ordinances, and in the execu-
tion of his duties as bailiff shall have all and the same powers as a con-
stable in criminal cases, and he shall possess the fees of a constable and
such other compensation as the Commissioners think proper.

188. The said Commissioners may pass ordinances to preserve the
health of the people in said town, ordering the cleaning of privies, sinks
or other places of deposit for refuse and unwholesome matter; to prevent
and remove nuisances, regulate or restrain the running at large of horses,
cattle, swine, geese, clucks or chickens within the limits of said town; to
prohibit the firing of guns or pistols, or shooting of fireworks within said
town; to prohibit and disperse the tumultuous meetings of idle, dissolute
or drunken persons; to provide and regulate the conduct of minors on the
streets of said town and of time minors shall be allowed on streets after
sundown; to provide for a tax on dogs of said town; to provide for work-
ing, mending, widening of streets; to provide for suppression of vice and
