and likewise appoint three persons for the elections to be held every two
years thereafter. The judges so appointed shall appoint a clerk. The polls
shall be opened at seven o'clock A. M., and remain open until four o'clock
P. M., at such place as may be designated by the Commissioners, and the
judges shall file with the Commissioners a report, and certificates of elec-
tion shall be signed by the judges to the Commissioners so elected. The
judges of election shall, before proceeding to act, take oath before some
Justice of the Peace of Wicomico County to permit all qualified voters
to vote, and that they will have said election conducted fairly and that no
one will be allowed to vote unless duly qualified and registered.

39. If any person elected as Commissioner shall refuse to serve as
such, or his place become vacant by death, resignation, disqualification or
otherwise, the remaining Commissioners may fill his place from among
the qualified voters of the town. Each Commissioner before he acts as
such shall make oath before some justice of the peace that he will dili-
gently and faithfully, and to the best of his skill, perform his duties as
Commissioner without favor, partiality or prejudice, and the justice of
the peace shall make out a certificate of such qualification, and shall file
the same with the Commissioners, and be recorded among the records of
the town, and the Commissioners shall meet the second Monday after their
election, and shall hold stated meetings the second Monday in every month
thereafter, and adjourned or called meetings can be called at any time
by the president of the board as may be necessary for transaction of busi-
ness, and a majority of the Commissioners shall constitute a quorum.

40. At their regular meeting after the election to be held on the second
Tuesday in April, 1929, and at their regular meeting every two years
thereafter, or as soon thereafter as practicable, the Commissioners shall
elect one of their members president, and shall also elect some person as
clerk of their body and some person as treasurer thereof. One person may
be elected as both clerk and treasurer, and a member of their body may
be elected to either or both of said offices, but if a person other than a
member of the Commissioners of Delmar shall be elected to one or both
of said offices, such persons must be a regular qualified voter of the town,
and must have been a taxpayer thereof for at least twelve months prior to
his election. At their second regular meeting after any election, the Com-
missioners shall elect a bailiff for said town who shall not be one of their
members, and they may appoint counsel and give him such compensation
as may be agreed upon. One and the same person may act as clerk and
treasurer, and the bailiff may be collector of taxes. Any of the above
named officers shall be subject to removal by a majority vote of the whole
number of Commissioners, and the compensation and duties of said offi-
cers shall be such as the Commissioners may from time to time prescribe
and determine.
