4930 ARTICLE 22.

this Act, he shall be deemed guilty of a misdemeanor and upon conviction
thereof shall pay a fine to the county for each such offense not more than
the sum of five hundred dollars, to be imposed by the Circuit Court for
Washington County and collected as other fines are.

757. The county commissioners shall allow the sheriff of said county
for the transportation of all prisoners sentenced by the judge of the Cir-
cuit Court to the penitentiary and other reformatory institutions of the
State the actual sum laid out by the sheriff in railroad, other transporta-
tion for himlself, necessary guards and prisoners, together with an addi-
tional sum not exceeding five dollars ($5.00) for each prisoner conveyed
from the county to the place of confinement by said court.

758. The inhabitants of the town formerly known as Smithsburg, in
Washington county, are created a corporation, by the name of "The
Burgess and Commissioners of Geneva," and by that name shall have per-
petual succession, may be sued and may sue, may have and use a common
seal, and possess such other incidents and powers as attach by law to a
municipal corporation, and may purchase and hold real, personal and
mixed property for the benefit of said corporation; provided, however,
that the burgess and commissioners shall not purchase or acquire any real
estate, unless the said burgess and commissioners, shall first provide by
ordinance for said purchase, and the mode and manner of payment there-
for ; and all ordinances for the purchase of real estate shall provide for the
submission of the question of said purchase to the qualified voters of the
town at some regular election for the election of burgess, assistant burgess
and three commissioners of said town; such ordinance, before being sub-
mitted to qualified voters of the town, shall be posted in at least ——— of
the public places of said town, for four weeks previous to its submission
to the qualified voters of said town; and no ordinance for the purchase
of real estate shall be of any force or validity unless it shall receive a
majority of the votes cast at such election.

759. The government of said town shall be vested in a burgess, assistant
burgess and three commissioners, to be elected as hereafter provided.

760. The taxable limits of the town of 'Smithsburg are hereby declared
to be as follows :

Beginning at a stone planted on the western margin of the public road
leading from Smithsburg to Leitersburg, said stone being five and seventy-
six hundredths (5.76) perches from the north corner of the stable now
standing on the lot formerly belonging to Mr. Edward Clark, and running
thence south seventy-six and one-half (76 1/2) degrees, east one hundred and
