737. All by-laws and ordinances heretofore passed by the burgess and
commissioners of Sharpsburg, now in force, and not in conflict with the
provisions of this act, are hereby continued in force, until the same are
repealed or modified; and all acts or parts of acts done and performed by
the said burgess and commissioners of said town in discharge of their
regular duties, prior to the passage of this act, are hereby declared to be
valid and binding upon said town and its inhabitants thereof; provided,
the same are not in conflict with any of the by-laws or ordinances of the
town heretofore passed.

738. Every ordinance shall require at least a majority vote of the
commissioners for its passage, and shall be sent to the burgess for his ap-
proval, and he shall return the same to the next regular meeting with his
approval or disapproval. Should he approve the same it shall forthwith
become effective; should he disapprove it, it shall not become a law unless
it be passed at the first regular meeting thereafter by a vote of four-fifths
of the commissioners.

739. The Burgess and Commissioners shall have power to compel all
turnpike companies, whose roads or any part thereof lie within the town,
to perform all the duties and obligations imposed upon them by their
respective charters or laws of this State upon such parts of said roads as
are within the limits of said town; they shall also have power to enter into
agreements with said companies in relation to the grading, paving or re-
pairing of the parts of their respective roads lying within said town.

740. The several turnpike companies owning roads running into the
town, may cede to the town such parts of their roads as lie within the limits
of the town, upon such terms as may be agreed upon between the burgess
and commissioners and the companies, and the same when ceded, shall in
all respects be subject to the same regulations as the public streets of
said town.

741. The burgess and commissioners shall have power to condemn the
parts of all public highways lying within the limits of the town for public
use, and to open, widen, straighten or, close up the same in whole or in
part.

742. The burgess and commissioners of Sharpsburg may impose and
appropriate fines, penalties and forfeitures for the breach of their ordi-
nances, and that all fines shall go to the corporation, and shall be appro-
priated as directed by ordinances.
