misdemeanor, and shall, upon trial and conviction thereof, for each and
every offense be subject to a fine of not less than Fifty ($50) Dollars nor
more than Five Hundred ($500), or be imprisoned in the Washington
County jail for a period of not less than one (1) month nor more than one
year, or be both fined and imprisoned in the discretion of the Court as
aforesaid.

681. This Act shall not apply to, nor prohibit the manufacture for sale
of alcoholic, spirituous, vinous, malt and intoxicating liquors, or the trans-
portation thereof, where such liquors are manufactured for sale and sold
only for delivery for shipment to places beyond the State, or to places
within this State where such sale is not now or hereafter prohibited by law.

682. It shall be lawful for any livery stable keeper in Washington
county to retain in his custody any horse, mare or gelding placed under
his care for livery, and also any vehicle, until all charges for their keeping
shall have been paid by the owner.

683. It shall and may be lawful for such livery stable keeper to sell
any such horse, mare or gelding, or vehicle, at public auction, for cash,
in Hagerstown, in said county, after giving at least three weeks' public
notice of the time, place and terms of sale, in one or more newspapers
published in said county, prior to the day of sale; and after deducting the
amount due for such keeping, together with all the expenses attending
said sale, he shall pay over the surplus, if any, to the owner of such horse,
mare or gelding, or vehicle.

684. Before proceeding as above, it shall be necessary for such livery
stable keeper to state an account for the keeping of such horse, mare or
gelding, or vehicle, and prove the same before a justice of the peace for
the county, who, upon being satisfied by proof of demand, and refusal or
neglect to pay on the part of the owner of said property, shall thereupon
issue his warrant authorizing such sale as aforesaid; provided, that the
proprietor of such livery stables shall set up on his premises, in some
conspicuous place, a copy of this sub-title of this article, printed in large
type, together with his rates of livery.
