the lease), or any other like method of acquisition, or by condemnation,
any land or property, lot or lots necessary in the opinion of said Mayor
and Council, for the carrying out of the purpose of this Act.

SALE OF CITY PBOPEETY.

433. The Mayor and Council of Hagerstown are hereby authorized and
empowered to sell and convey, lease, or otherwise lawfully dispose of the
whole or any part of any real estate and personal property within and/or
without the corporate limits of said Hagerstown and owned by said Hagers-
town that in the opinion of said Mayor and Council is not needed for
municipal purposes, the proceeds arising from any such sale, lease, or
other disposition of such property to be deposited in the name of the Tax
Collector of Hagerstown to the credit of the "Miscellaneous Fund of the
City" and to be paid out, only on warrants signed by the Mayor and en-
dorsed by the Clerk of said Hagerstown, for municipal purposes; provided,
however, that it shall be unlawful for said Mayor and Council, and said
Mayor and Council shall not have any power or authority, to sell, lease,
or otherwise dispose of the whole or any part of the real estate and personal
property owned by said Hagerstown within and/or without the corporate
limits of said Hagerstown that is now, or that shall hereafter be, used in
the operation of or in connection with the municipal electric light plant,
except to sell or otherwise dispose of any machinery and equipment for the
purpose of immediate replacement only, unless and until all the following
requirements shall have been fully complied with : said Mayor and Council
shall first cause to be published at least once a week for four successive
Weeks in each daily newspaper published in said Hagerstown a notice
signed by said Mayor and Council that said Mayor and Council propose
to sell, lease, or otherwise dispose of, as the case may be, certain property,
describing it, used in the operation of or in connection with the municipal
electric light plant, said notice to be published not more than three months
before the election at which the question of such proposed sale, lease, or
other disposition of said property is to be voted on as hereinafter pro-
vided for; said Mayor and Council shall then have the question of such
proposed sale, lease, or other disposition of said property submitted to the
vote of the duly qualified voters of said Hagerstown at the next general
municipal election thereafter by causing to be printed on the ballots the
words "For proposed sale of light plant property" and "Against proposed
sale of light plant property" or "For proposed lease of light plant prop-
erty" and "Against proposed lease of light plant property" or "For pro-
posed disposition of light plant property" and "Against proposed disposi-
tion of light plant property," as the case may be; and if a majority of the
duly qualified voters voting on said question shall vote "For" the proposed
sale, lease, or disposition of said property, as the case may be, then said
Mayor and Council shall have the power and authority to make the pro-
posed sale, lease, or other disposition of the property described in the said
