4820 ARTICLE 22.

1920, ch. 56, sec. 8.

429. In addition to the powers expressly conferred by this Act, the
Mayor and Council of Hagerstown shall have such other powers as are in-
cident thereto, or a necessary consequence to the powers herein conferred,
which shall include the right to pass all ordinances not inconsistent with
the powers granted by this Act that may be necessary for the protection
and preservation of said lake, or any portion thereof, and to attach rea-
sonable penalties thereto for violations thereof, and from time to time
to repeal, alter and amend said ordinance.

PENSIONS.

1927, ch. 105.

430. The Mayor and Council of Hagerstown are hereby empowered
and authorized, whenever in their discretion the efficiency of the Fire
Department of Hagerstown may require it, to retire upon the recom-
mendation of the Chief Fire Marshal any regular driver, tiller or chauf-
feur of any of the fire apparatus of said city, appointed by the various
Fire Companies and paid by the city, and to pay him for life a sum of
money on monthly installments, equal to one-half of the compensation
allowed him at the date of his retirement, provided, however, that such
regular driver, tiller or chauffeur shall have served faithfully as a driver,
tiller or chauffeur in the fire department for not less than fifteen years or
he shall have been permanently disabled in the discharge of his duty as
driver, tiller or chauffeur in the fire department of Hagerstown. The
Chief Fire Marshal shall, before making such recommendations, procure
and file with the Mayor and Council of Hagerstown, a certificate signed
by at least two reputable physicians of said city, that the person proposed
to be retired has been thoroughly examined by them and that he is in-
capable of performing active duty in the capacity in which he is em-
ployed.

MARKET.

1924, ch. 363, sec. 1.

431. The Mayor and Council of Hagerstown is hereby authorized and
empowered to borrow a sum of money not exceeding One Hundred and
Fifty Thousand Dollars ($150,000) or so much thereof as may be neces-
sary, upon the faith and credit of Hagerstown, as hereinafter provided,
and to issue and sell coupon bonds to raise said sum of money, which said
issue of bonds shall be known and designated as "Hagerstown Market
Building Bonds," and the money arising from the sale of said bonds shall
be used exclusively for the purchasing of a ]ot or lots as a site for a Market
House or Building, and also, for the construction, erection and mainte-
nance of a Market House or Building on said lot or lots.

432. The said Mayor and Council are hereby authorized and empow-
ered to acquire by gift, grant, purchase, lease (whatever the duration of
