sions of this section shall be liable to the penalties prescribed in the
Public General Laws, Article 72, title "Oysters," Section 20, for taking
oysters with rakes or tongs without license.

401. Any resident of Anne Arundel County desiring to use any canoe
or other boat in catching or taking oysters for sale, or for any other
purpose, with rakes or tongs, in any of the waters of said county, shall
first obtain a license therefor by application to the clerk of the Circuit
Court of said county; provided, however, that such license shall not au-
thorize the use of said canoe or boat in taking or catching oysters on the
natural bed or beds in the water of South River; nor in any creek, cove,
arm or inlet of South River in said county, above a line drawn in a
northeasterly direction from Turkey Point to Ruler's Deep Hole on the
north bank of said river; nor in West River and Rhode River above a
straight line drawn from Dutchman's Point on the east or northeast bank
of Rhode River in a southeasterly direction to Curtis Point on the swamp
shore of West River; nor in any inlet, cove or tributaries of said rivers,
for the period of two years from the' first day of September, 1894; nor
in the Severn River within a straight line drawn from Chink Point bar
to Greenbury's Point bar in said river, and a straight line drawn in a
northeasterly direction from the Santee's Wharf, at the U. S. Naval
Academy to the east tank of said river immediately opposite said wharf,
for the period of one year from the first day of September, eighteen
hundred and ninety-four; and that all such license shall be granted in the
same manner and upon the same terms and conditions as provided in Arti-
cle 72 of the Code of Public General Laws of Maryland, title "Oysters,"
sub-title "Tonging," and the amendments thereto.

402. If any person shall use any canoe or boat not licensed as required
by the preceding section, in taking or catching oysters with rakes or
tongs in the waters of Anne Arundel County, or if any person having
such license shall take or catch any oysters with rakes or tongs on the
natural beds or bars in the waters of South River, West River, Rhode
River and Severn River, or any creek, cove, arm or inlet thereof, above
the said lines drawn as provided in the preceding section, he shall upon
conviction thereof before any justice of the peace of said county, or in
the Circuit Court for said county, be fined not less than twenty dollars
nor more than one hundred dollars; and in case of refusing to pay said
fine and cost of prosecution, the said party shall be confined in the Mary-
land House of Correction for three months; and in all cases under this
section the accused shall have a right to appeal from the justice of the
peace to the Circuit Court for the said county; provided, that nothing in
this Act shall be construed to prevent persons engaged in planting oysters
in South River, West River, Rhode River and Severn River, from re-
moving or planting the same.
