County, shall first obtain, by application to the Clerk of the Circuit Court
of Dorchester County a separate license for every person to be employed
on such boat; and that any resident of Dorchester or Talbot Counties
desiring to take or catch oysters with rakes or tongs for sale in the water
of the Choptank River within said Counties shall first obtain, by appli-
cation to the Clerk of the Circuit Court of the County wherein he may
reside, a separate license for every person to be employed on such boat,
and such license shall have effect from the first day of October in the year
in which it has been obtained until the twenty-fifth day of April, in-
clusive, next succeeding; except in the Choptank River in said Counties
wherein it shall effect from the 15th day of September; provided, that
nothing in this Act shall be so construed as to prevent the citizens of
Dorchester and Talbot Counties obtaining an oyster license under this
Act from using the waters of the Choptank River in common, or the citi-
zens of Dorchester and Wicomico Counties from using the waters of the
Nanticoke River in common.*

383. The waters of Talbot County lying within the following lines—
that is to say, from a line drawn from Lowe's Point on the mainland to
North Point on Poplars Island; thence to the buoy on North Point of
Poplars Island; thence to Wade's Point buoy; thence to Wade's Point,
are hereby open to residents of Talbot County who may hold a license
to take oysters with scrape, scoop or dredge in the water of Talbot County,
issued by the Clerk of the Circuit Court for Talbot County.

384. Any person who shall take oysters with scrape, scoop or dredge
within the limits defined in the preceding section, without having first
obtained a license, as provided in said section, shall be deemed guilty of
a misdemeanor, and upon conviction thereof by any Judge of the Circuit
Court or justice of the peace of said county, before whom such case may
be tried, shall be fined not less than twenty-five dollars, nor more than
one hundred dollars, or forfeit the boat or vessel in possession of the party
offending, together with papers, furniture and tackle on board, or both,
in the discretion of the judge or justice trying such case.+

385. The following waters of Talbot county are hereby declared as to
be used only for taking and catching oysters with tongs worked exclusively
by hand, namely, by a straight line drawn from Paw-Paw point, on Tilgh-
man's Island, to the southwesternmost point of Poplar Island, and by a
straight line from Lowe's point, on the mainland, to the end of North
point, on Poplar Island, and all the waters of Talbot county within said
lines shall be used only by tongers who take or catch oysters with tongs
