facture, which may be selected by the person making the test, by an
open burner consuming five cubic feet of gas per hour, and shall, as re-
gards purity, comply with the standard now or hereafter established by
law or ordinance. The gas shall not contain more than twenty grains of
sulphur in any form in one hundred cubic feet of gas.

221. If the illuminating gas supplied by any person or persons, cor-
poration or gas company, for public use in the town of Easton, for which
a charge shall be made, shall be at any time of less illuminating power or
of less purity than according to the standard established by section 220
of this subtitle, it shall be so reported to the flavor and Council of Easton
by the person or inspector selected to make the test, or tests, and the
person or persons, corporation or gas company, supplying the same shall be
subject to a penalty of fifty dollars and costs for each and every day that
such violation shall continue; provided, however, that if it shall appear
that such deviation from the above named standard could not have been
prevented by ordinary care and prudence, but was occasioned by some
unavoidable cause (assuming that the plant is maintained in proper con-
dition) then the said penalty shall not he enforced while such unavoidable
cause shall continue; provided, however, if the offense becomes practically
continuous the same shall be sufficient cause and authority for the Mayor
and Council, in their discretion, by ordinance, to annul the franchise of
the offending person or persons, corporation or gas company.

222. On or before April 15th, 1914, the Mayor shall by and with the
advice and consent of the Council appoint three residents of the town
of Easton to be known as The Easton Utilities Commission, to operate,
manage and maintain the municipal sewerage system and water works and
all or any other revenue producing utilities which are now owned or may
be hereafter constructed or acquired by the town, to serve for one, three
and five years respectively, accounting from the first day of April, 1914.
They shall draw lots for the different terms, the highest number to take the
longest term and so on down to the lowest. Their successors shall be ap-
pointed one every two years, during the month of March, beginning with
the year 1915, and whose term of office shall commence April 1st, follow-
ing, to serve for six years; but if a vacancy shall occur at any time by
reason of death, resignation, removal from office or otherwise, the vacancy
shall be filled by the Mayor and Council in the same way as provided for
original appointment, by the appointment of a suitable person to serve
for the remainder of the term of the Commissioner by whose death, resig-
nation or removal from office the vacancy was created. The Commis-
sion so appointed shall have full charge of the operation, management
and maintenance of all revenue producing utilities of the town of Eas-
ton, as aforesaid, including the power to make contracts in the name
of the Mayor and Council of Easton, to sue in the name of the Mayor
and Council of Easton for the collection of any and all indebtedness
