he may deem necessary for the working, repairing and constructing of said
roads and bridges, to be paid for out of the levy made therefor as afore-
said by the County Commissioners of Somerset County, and he shall have-
charge and control of all teams, carts, wagons and other machinery and
implements which may be purchased, and all materials which may be pur-
chased for the use of said roads. He shall at least, once in each and every
month go over and carefully observe the condition of all the public roads
in Somerset County with a view to directing their proper repair and recon-
struction. He shall not work out or expend on the roads or bridges of said
County a greater sum in any one fiscal year than the amount levied by
the County Commissioners for this purpose. He shall appear before the
Commissioners at their first meeting in each and every month and make
a statement to them of the work done and materials furnished and money
expended. He shall examine and certify to the correctness of all bills and
accounts for any work done or materials furnished for any of the public
roads or bridges in Somerset County before the same shall be paid, and
no payments shall be made until such accounts have been certified by him.
He shall make annually in writing a detailed report of all work done on
and material furnished for the county roads and bridges for the year,
together with the names of all persons working on said roads and bridges,
and furnishing such material, and the amount to which each person is
entitled for such work done and materials provided, and which he has
certified as correct, which report shall be made before the first day of July
for the year ending on the first day of March, and in making such report
he shall be furnished by the Board of County Commissioners, with the
services of one of the Clerks or stenographers of said Board. Said county
road superintendent shall not be interested in the business of any person,
firm or corporation from which anything shall be purchased for the use
of said roads or bridges, or receive any commissions on any purchase so
made.

376. Any person appointed under the provisions of this Act whose
duty it shall be to keep accounts or make reports, who shall fail to do so,
or who shall wilfully make any false report or account, shall be liable to
indictment by the Grand Jury of Somerset County, and if convicted in
the Circuit Court thereof, shall be fined in a sum, in the discretion of the
Court, not exceeding $300, and shall make good the loss arising from said
neglect of duty or fraud.

377. It shall not be lawful for the County Commissioners, of Somerset
County to open any new roads in said county until they shall have such
proposed roads surveyed and laid out by the County Road Superintendent,
and an estimate in writing made by him of the cost of building such pro-
posed new road, including necessary bridges in the same, and any such
new public roads which the County Commissioners may hereafter decide
to open shall be built under the control and direction of the County Road
