party alleged to have been engaged in such violation, and forthwith bring
the offender before some justice of the peace of Somerset county for a hear-
ing; and the said justice of the peace shall either give the case an imme-
diate hearing, or at the instance of the party charged with such violation,
shall appoint some early day within the next seven days thereafter, to hear
the case, the party charged giving such good and sufficient bail as said jus-
tice shall require for his appearance at the trial; and on the conviction of
the offender, the said justice shall fine such person in a sum not less than
one hundred dollars nor more than two hundred dollars and costs, in each
and every case; and shall have power and authority to commit to the jail of
said county such offender so convicted until such fine so imposed, and
costs, shall be fully paid and satisfied, subject to an appeal in all cases to
the circuit court for Somerset county, from any judgment or conviction
which may be rendered by said justice of the peace.

259. All fines accruing from the enforcement of section 256, shall be
paid by the said justice of the peace to the secretary and treasurer of the
school board of Somerset county, for the use of the public schools of said
county.

260. The canoe, boat or vessel, so unlawfully used, shall be condemned
by the justice of the peace having jurisdiction, and shall be sold by the
sheriff or constable to the highest bidder for cash, after twenty days' notice
of the time, place and terms of sale, inserted at least three times in some
newspaper published in Somerset county; one-half of the proceeds of sale,
after the payment of all proper costs, charges and expenses, to be paid to
the informer, and the residue to the school board of Somerset county, for
the use of the public schools of said county.

261. It shall be the duty of the sheriff, constable and officers of the
State fishery force, to arrest any person, and to seize any canoe, boat or
vessel found violating any of the provisions of section 256, and bring the
offender before a justice of the peace in Somerset county, to be dealt with
as herein provided; and if the vessel so unlawfully employed be seized, but
the master or owner shall not be arrested, and shall wilfully fail to appear,
the justice of the peace may proceed to hear the charge against the boat
without such appearance; and if it shall appear that the said boat has
been unlawfully used in violating any of the provisions of said sections,
shall condemn the said boat, and order a sale thereof as provided for in the
preceding section; but in such case the owner or master of said canoe, boat
or vessel, or any one interested in the said canoe, boat or vessel, shall have
the right of appeal to the circuit court for Somerset county, which shall
hear and determine the said case as in other cases of appeal from justices
of the peace.
