and all other moneys received for fines, to the secretary and treasurer of
school board of said county for the use of the school fund, on or before
the first Monday in June in each year, and his official bond shall be liable
for the prompt payment thereof.

255. All oysters taken in any of the waters of Somerset county, shall
be culled on the beds or bars where taken or caught, and all oysters of a
less size than two and one-half inches in length, measured from the hinge
to the mouth, together with the shells, shall be left on their natural bars
or beds after a sufficient time has elapsed for their culling and throwing
over the same after taking them as aforesaid; and the possession of any
such oysters and shells on board of any vessel in the waters of said county,
or in the possession of any other person in the State of Maryland, when
the said oysters and shells have been taken as aforesaid in the said waters
of Somerset county in quantities of five bushels or more shall be prima
facie evidence that the same are unculled and a violation of the provisions
of this act, and the person or persons having possession of such oysters and
shells shall be subject to all the fines and forfeitures herein named; and
the oysters and shells the possession of which is contrary to the provisions
of this sub-title, shall be confiscated and returned to the natural beds or
bars where taken at the owner's expenses; and any justice of the peace of
the State of Maryland shall have jurisdiction to hear and decide such
cases, and impose the penalties of this act whenever the said unculled
oysters, as above set forth, may be found on boat or in the possession of
any person within the limits of said Somerset county.

256. It shall not be lawful for any person to employ any canoe, boat
or vessel in catching or taking oysters with scoup, scrape, drag or dredge
or any similar instrument, either on public or private beds within the
waters of Manokin River, in Somerset County, east of a straight line from
Hazard Point, on the Sound side of said river, to South Point, on the
southeast end of Little Deals Island.

257. Any person violating any of the provisions of the preceding sec-
tion, shall be fined in a sum not less than one hundred dollars nor more
than two hundred dollars for each and every offence, and shall stand com-
mitted to the county jail until such fine and costs shall be fully paid and
satisfied.

258. On information under oath, of any violation of the provisions
of section 256, to any justice of the peace of Somerset county, the said
justice shall forthwith issue his warrant to the sheriff or any constable of
said county, requiring the officer to whom the said writ shall be directed, to
summon a posse comitatus, if necessary, and proceed at once to arrest the
