3984 ARTICLE 17.

the highways, roads, bridges, railroads, street railways and other arteries
of traffic; the manner of effecting such co-relationship, and what improve-
ments and new facilities should be provided for a comprehensive and co-
ordinated development of transportation for the District, and the Com-
mission is further directed to submit to the Maryland Legislature of 1929
and to succeeding Legislatures any other recommendations respecting leg-
islation which the Commission, as a result of its activities, may regard as
to the best interests of the District.

737. Every act or omission designated as a misdemeanor in this Act,
unless otherwise provided, shall be punishable before any justice of the
peace or the Circuit Court of the County in which such offense is com-
mitted and shall be brought by warrant or indictment upon the oath or
information of any member of said Commission or any employee thereof,
and the offender shall, upon conviction, be subject to a fine not exceeding
one hundred ($100.00) dollars or thirty days in the County Jail, or both,
in the discretion of the Court. Where such an act or omission is of a
continuing nature or is persisted in, in violation of the provisions of this
Act or of any rule or regulation formulated thereunder, a conviction for
one offense shall not be a bar to a conviction for a continuation of such
offense subsequent to the first or any succeeding conviction.

738. For the protection of the health, morals, safety or welfare of the
District, the Commission shall have the power to frame and adopt a plan
or plans for dividing the District into zones or districts, representing the
recommendations of the commission for the limitations and regulation of
the height, the bulk and location including percentage of lot occupancy,
set-back building lines, and area and dimensions of yards, courts and other
open spaces, and the uses of buildings and other structures and of prem-
ises in such zones or districts.

739. Whenever the Commission certifies to the County Commissioners
of Montgomery or of Prince George's Counties, any such plan for the
districting or zoning of the portion of the District within each County
according to the uses of buildings and other structures and of premises,
then said County Commissioners of the county affected acting as the legis-
lative body of the portion of the District located in that County and hereby
designated for the purposes of this and subsequent sections of this Act
as District Council, in the interest of the promotion of the health, morals,
safety or welfare of the District, may, within the limits of that portion
of the District within that County regulate and restrict the location of
buildings and other structures and of premises to be used for trade, in-
dustry, residence or other specified uses, and for said purposes divide such
portion of the District into zones of such number, shape and area as may
be deemed best suited to carry out the purposes of this section. For each
