3902 ARTICLE 17.

hear and determine the matter as any case arising under the laws of the
State, and shall receive the same fees therefor, but in all such cases the
bailiff shall bring such complaint before a justice of the peace.

552. In the event of a vacancy in the office of justice of the peace resi-
dent in the town, or in case of sickness, absence or disability of said jus-
tice, the hearing of the case or transaction of the business assigned to said
justice by this charter may be had before any other justice of the peace in
and for Prince George's county, and the Mayor and Common Council of
Hyattsville may provide for the expense so incurred.

ORDINANCES—STYLE OF.

1908, oh. 79, sec. 32. 1912 Code, sec. 328.

553. The style of all ordinances shall be: "Be it enacted and ordained
by the Mayor and Common Council of Hyattsville," and all suits at law
for the violations of any rules, ordinances, regulations and by-laws shall
be instituted in the name of the Mayor and Common Council of Hyatts-
ville, against offending parties, and all fines recovered in such suits at law
for the breach of any rule, ordinance, regulations or by-laws of the corpo-
ration, before any justice of the peace of Prince George's county, resident
in said town, shall be collected by said justice and paid over to the treas-
urer of said corporation within one month after the collection of the same,
and the said justice shall render an account to the Mayor and Common
Council every month, or oftener, if required, of the amount so received
by him, and in the event of failure of any justice to account for and of
said collections, he shall be fined and pay not-less than one hundred dol-
lars, to be imposed and collected as other fines imposed by the penal laws
of the State.

554. All streets, avenues, roads and alleys in the corporate limits of
Hyattsville are hereby declared to be under the supervision and control
of the Mayor and Common Council, but hereafter no street, avenue, road
or alley shall be accepted until the same has been graded and graveled or
macadamized; provided, that whenever the Mayor and Common Council
of Hyattsville shall determine it to be necessary for the public benefit that
any of said unaccepted streets, avenues, roads or alleys should be taken
over by it, it shall take supervision and control of the same and do such
repair and construction work therein as it may deem proper.

The said Mayor and Common Council may, after it shall have deter-
mined it to be necessary for the public benefit, construct therein sidewalks,
curbs, gutters and roadbed and street improvements, (which improve-
ments may be constructed all at the same time or at different times,) and
