1922, oh. 52, sec. 37.

179. In the event of a vacancy in the office of the Justices of the Peace,
residents of the town, or in the case of sickness, absence or disability of the
said justices, the hearing of the case or the transaction of the business
assigned to the said justices by the charter, may be had before any other
Justice of the Peace in and for Prince George's County; and the Mayor
and Common Council of Capitol Heights may provide for the expense so
incurred.

1922, ch. 52, sec. 38.

180. The bailiffs shall perform such services as said Mayor and Com-
mon Council shall direct. They shall arrest and carry before a Justice
of the Peace of Prince George's County as provided in the preceding sec-
tion, to be dealt with as hereinbefore provided, any person found breaking
the peace or disturbing the quiet of said town or violating any of the
ordinances of said town.

1922, ch. 52, sec. 39.

181. The Mayor and the Common Council shall have power to impose
a license upon all circuses, menageries, theatrical exhibitions, and other
amusements for gain, exhibiting within the limits of the town, not exceed-
ing fifty dollars for each show or exhibition, provided that this section
shall not apply to the entertainments given for religious benefits or chari-
table purposes, nor to entertainments given by the residents of the town
not for gain. The Mayor and the Common Council shall also have power
to impose a license upon all businesses operating within the limits of the
town of Capitol Heights.

1922, ch. 52, sec. 40.

182. The style of all ordinances shall be "Be it enacted and ordained
by the Mayor and Common Council of Capitol Heights." All actions and
prosecutions for the violations of any rules, ordinances, regulations, shall
be instituted in the name of the Mayor and Common Council of Capitol
Heights against offending parties, and all fines recovered in such suits,
actions or prosecutions for the breach of any rule, ordinance, or regula-
tion of the corporation before any justice of Prince George's County shall
be collected by the said justice and paid over to the Mayor and Common
Council every month or oftener if required, and in the event of failure
of any justice to account for any of said collection he shall be fined and
pay not less than one hundred dollars ($100) to be imposed and collected
as other fines imposed by the penal laws of this State.

183. There shall be appointed annually by the Mayor and Common
Council in said town, and in the same manner and possessing the same
qualifications as the Mayor, one person as supervisor, whose duty it shall
be to superintend the improvements of the town, and who shall perform
