the other half to the owner, and if no owner shall claim the said swine
on the day of sale said half shall go to the commissioners of the village
for the use of said village, provided, that if the owner of any swine
impounded under this section shall prove to the satisfaction of any justice
of the peace residing in said village, that the swine did not go at large
±rom negligence or want of care on his part, and that due diligence was
used to prevent it he shall have return of the property on paying all ex-
penses of keeping and proving the same, and fifty cents, for taking up
each one of such swine

54. The public ground and property within said corporation, belong-
ing to the village, shall be vested in the commissioners, so far as to pre-
serve the same, to prevent depredations thereon, and to have and to hold
for the benefit of said corporation

alty prescribed by said ordinances, and to enforce payment of the same
