3638 ARTICLE 16.

1906, ch 795, sec 22 1912, ch 790, sec 562

938. The commissioners of the county, the board of public school com-
missioners, justices of the peace, sheriffs, constables and all other State
and county officers shall have, hold and exercise their offices in said town
as heretofore, except as qualified by the other sections of this Act The
County Commissioners of Montgomeiy County shall, on or before the first
day of January, 190Y, and on or before the first day of January in each
and every year thereafter, pay over to the Town of Somerset that pro-
portion of the entire county levy for the entire roads which the total real
property assessed within the limits of the Town of Somerset shall bear
to the whole amount of assessed real property in Montgomery County, so
that the Town of Somerset shall receive and disburse for the maintenance
of the streets of said town the amount levied for the repair of roads by
the said County Commissioners of Montgomery County, upon the real
property within the corporate limits of the Town of Somerset

939. This act is hereby declared to be a public act, and may be used
in evidence in all the courts of this State without proof.

940. Neglect or non-use shall not work a forfeiture of this charter.

941. The Mayor and Council of the town of Somerset, in the county
of Montgomery, are hereby authorized, empowered and directed to con-
struct sewers in any of the stieets of the town of Somerset whenever it
shall be necessary in the opinion of said Mayor and Council to construct
sewers in any of the streets of the town of Somerset, when owners repre-
senting forty (40) pei cent oi the property abutting on the line of said
sewers shall petition for the same, and the entire cost of same shall be
assessed against the property abutting on said street or streets, and the
money due from the said assessment shall be a lien on said abutting prop-
erty and collected as other taxes are collected by the Mayor and Council,
provided, that before any special tax be levied upon this act notice shall
be served upon said abutting property owner of the purpose and probable
amount of special tax by mailing of a copy thereof by the clerk of said
Mayor and Council to the last known residence of the owner or owners of
said abutting property, which notice shall provide a time and place when
and after which said owner or owners shall have the light to be heard
with reference thereto

time and of their own volition, and without petition being filed, to open,
alter, improve, locate, re-locate or close any public highway, avenue, stieet,
lane or alley, provide necessary drainage for any public highway, avenue,
