the preceding section and all of the duties imposed by this Act upon the
Board of County Commissioners shall be performed by the said Board
only after consideration of the recommendation of the County Commis-
sioner in whose District the duty is to be performed or the improvement
is to be made.

639. Property abutting on existing highways within the District which
have been built from private funds and which highways the board may
by ordinance determine will remain as improved for a designated period
of years, shall be exempted for such period of years from the levy of the
tax herein authorized for the payment of the interest and the retirement
of any part or all of the issue of the "Montgomery County Suburban Dis-
trict Road Bonds of 1927."

640. As soon as may be after the passage of this Act, the Board of
County Commissioners shall divide all property within the Montgomery
County Suburban District into one of the four following classes: (1)
Agricultural, (2) Undeveloped, (3) Residential, whether improved or
unimproved, and (4) Industrial or Business. Property classified as (1)
Agricultural and property classified as (2) Undeveloped shall not be
assessed for tax purposes under the provisions of this Act, so long as it
remains so classified. Within thirty days prior to making the next annual
tax levy under this Act, the County Commissioners shall give notice of
their intention to classify property as herein provided and shall hold at
least one public hearing thereon, and such further hearings as may be
necessary to afford every owner of affected property the right to be heard
with respect to such proposed classification. And within thirty days prior
to making succeeding annual levies under this Act the County Commis-
sioners shall give notice of their intention to reclassify any property which
in their judgment should be redassified and shall hold at least one hear-
ing before such change in classification is made. With respect to both
the original classification and the re-classification of property as herein
provided, the required notices shall be given and the required hearings
shall be held in the manner prescribed in Section 637 of this subtitle.

641. Every Act or omission designated as a misdemeanor in this Act,
unless otherwise provided, shall be punishable before the Circuit Court
of Montgomery County or the Police Justice at Rockville, shall be brought
by warrant or indictment upon the oath or information of any member
of the Board of County Commissioners or any employee thereof, and the
offender shall, upon conviction, be subject to a fine not exceeding one hun-
dred ($100) dollars or thirty days in the County Jail, or both, in the
discretion of the Court. Where such an act or omission is of a continu-
ing nature or is persisted in in violation of the provisions of this Act or
